Terms of Service

These Terms of Service (“Terms”) govern your use of SocialPublisher (the “Software”), provided by PUGGYROOM (“we”, “us”). By installing or using the Software, you agree to these Terms. If you do not agree, do not use the Software.

1. What the Software does

SocialPublisher is a desktop application that runs on your own computer. It lets you prepare a video once and publish it, immediately or at a scheduled time, to your own accounts on YouTube, TikTok, Facebook Pages and Instagram through each platform’s official API.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for publishing content to accounts that you own or are authorized to manage. You may not resell the Software or use it to provide a publishing service to others without our written permission.

3. Third-party platforms

The Software connects to services operated by third parties. When you use them through the Software, you must also comply with their terms, including:

– YouTube Terms of Service (https://www.youtube.com/t/terms) and the Google Privacy Policy (https://policies.google.com/privacy)
– TikTok Terms of Service (https://www.tiktok.com/legal/terms-of-service)
– Meta Terms of Service (https://www.facebook.com/terms.php) and Instagram Terms of Use (https://help.instagram.com/581066165581870)

These platforms decide what content is accepted, how it is displayed, and what limits apply (for example, daily upload limits or visibility restrictions). We do not control these platforms and are not responsible for their availability, decisions or changes to their APIs.

4. Your accounts and credentials

You are responsible for the platform accounts you connect, for any developer credentials you configure in the Software, and for keeping your computer secure. You can disconnect accounts at any time in the Software and revoke access in each platform’s settings.

5. Your content

You are solely responsible for the content you publish using the Software. You confirm that you own or have all necessary rights to that content, including any music, images and other material it contains, and that publishing it does not violate any law or the rights of others. We do not review, store or claim any ownership of your content.

6. Acceptable use

You agree not to use the Software to:

– publish spam, misleading content, or content that violates any applicable law or platform policy;
– publish to accounts you do not own or are not authorized to manage;
– circumvent platform rate limits, review processes or other technical restrictions;
– interfere with, reverse engineer or misuse any platform API.

8. Disclaimer of warranties

The Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that publishing will always succeed, happen at an exact time, or that the Software will be error-free or uninterrupted.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, revenue, followers or account access, arising from your use of or inability to use the Software, including any action taken by a third-party platform.

10. Termination

You may stop using the Software at any time. We may suspend or end your license if you violate these Terms. Sections 5, 8, 9 and 12 survive termination.

11. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Software after an update means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of [JURISDICTION], without regard to its conflict of law rules.
